Last updated: October 15, 2026
1. Who we are
This Privacy Policy explains how UPVIDEO INOVA SIMPLES (I.S.)("Company," "we," "us," or "our"), CNPJ 68.293.093/0001-23, operating the 123upvideo service from Avenida Oeste, 1700, Apt 304, Setor Central, Goiânia, GO, CEP 74045-155, Brazil, collects, uses, discloses, and protects personal information.
Contact for privacy requests: contact@123upvideo.com. This Policy is designed for users in the United States (including California residents under the CCPA/CPRA, where applicable) and also reflects our practices for other users, including Brazil (LGPD).
2. Scope
This Policy applies to personal information we process when you visit our website, create an account, purchase a subscription, upload videos or other media for AI processing, or otherwise use 123upvideo. It does not cover third-party websites or services that we do not control.
3. Categories of information we collect
Depending on how you use the Service, we may collect:
- Identifiers: email address, account/user ID, IP address, device or browser identifiers, and similar online identifiers.
- Customer records / commercial information: subscription plan, credits, purchase history, and billing status (payment card data is processed by Stripe or other processors; we do not store full card numbers).
- Internet / network activity: pages viewed, referral URLs, approximate location derived from IP, event logs, crash/error diagnostics (e.g., Sentry), and analytics events.
- User content: videos and related files you upload (Inputs), generation metadata, and resulting files (Outputs). Inputs may contain personal information about you or others if present in the media.
- Inferences: limited product inferences such as feature usage patterns used to operate and improve the Service (not for eligibility decisions with legal effects).
We do not intentionally collect government ID numbers, precise geolocation, or biometric identifiers for identification. Please do not upload sensitive personal information you are not authorized to process.
4. Sources of information
- Directly from you (account, uploads, support emails).
- Automatically from your device/browser (cookies, SDKs, logs).
- Service providers (authentication, payments, cloud processing, analytics/advertising tags when enabled).
5. How we use information (purposes)
- Provide, operate, secure, and troubleshoot the Service.
- Process Inputs with AI/cloud infrastructure to produce Outputs.
- Process payments, prevent fraud, and manage subscriptions.
- Send transactional messages about your account or billing.
- Measure performance, debug, and improve product quality and UX.
- Run marketing/analytics (e.g., Google Tag Manager and Meta Pixel) when enabled, including measuring ad campaigns.
- Comply with law, enforce Terms, and protect rights and safety.
6. Disclosure of information
We may disclose personal information to:
- Service providers / processors: Firebase/Google (auth & database), Stripe (payments), Modal or similar cloud GPU providers (video processing), hosting/CDN, email/infrastructure, and security/monitoring tools.
- Advertising / analytics partners: when tags are enabled (for example Google and Meta), they may receive online identifiers and event data to measure or deliver ads.
- Legal and business transfers: if required by law, to protect rights/safety, or in connection with a merger, acquisition, or asset sale.
We do not sell personal information for money. Under California law, certain advertising cookies/pixels may be considered "sharing" or a "sale" of personal information for cross-context behavioral advertising. See Section 9 for opt-out rights.
7. AI processing of your videos
When you upload media, files are transmitted to our systems and subprocessors for inference and temporary storage so we can deliver Outputs. Retention of generated assets is limited to what is needed to provide download/history features and operate the Service; we may delete files after a period or upon account deletion requests, subject to legal holds and backup cycles.
Unless we clearly state otherwise, we do not use your Inputs/Outputs to train unrelated third-party foundation models. Do not upload content you do not have the right to process.
8. Cookies and similar technologies
We use:
- Essential cookies (session, auth, locale/market preferences).
- Analytics and advertising cookies/pixels when GTM or similar tools are configured.
You can control cookies through your browser settings and, where available, platform opt-outs (for example Meta Ad Preferences / Google Ads Settings). Blocking some cookies may affect site functionality.
9. Your privacy rights (U.S. / California)
Depending on your state of residence, you may have rights to: know/access personal information we collected; delete; correct; obtain a portable copy; opt out of sale/sharing for cross-context behavioral advertising; limit use of sensitive personal information (if we collect it); and not be discriminated against for exercising rights.
How to exercise rights: email contact@123upvideo.com with the subject line "Privacy Request" and describe the request (access, deletion, correction, or do-not-sell/share). We will verify your identity (for example by confirming control of the account email) and respond within the time required by applicable law (generally up to 45 days under CCPA, with a possible extension when permitted).
Do Not Sell or Share: to opt out of sale/sharing for cross-context behavioral advertising, email contact@123upvideo.com with "Do Not Sell or Share" in the subject, or use browser Global Privacy Control (GPC) signals where we are able to honor them. Authorized agents may submit requests as allowed by law.
CCPA/CPRA applies to businesses that meet statutory thresholds. We provide these disclosures and mechanisms in good faith for California and other U.S. users regardless of whether a threshold currently applies.
10. Brazil (LGPD) rights
If you are in Brazil, you may request confirmation of processing, access, correction, anonymization/blocking/deletion, portability, information about sharing, and revocation of consent, where applicable, by contacting contact@123upvideo.com. You may also contact Brazil's ANPD regarding personal data protection matters.
11. Retention
We retain personal information for as long as your account is active and as needed to provide the Service, resolve disputes, enforce agreements, and meet legal, tax, and accounting requirements. Video Inputs/Outputs and job logs are retained for shorter operational windows when feasible. When retention ends, we delete or de-identify data, subject to backup and disaster-recovery copies that rotate on a delayed schedule.
12. Security
We use reasonable administrative, technical, and organizational measures appropriate to the nature of the data (access controls, encrypted transit where supported, least-privilege practices). No method of transmission or storage is 100% secure.
13. International transfers
We are based in Brazil and use cloud providers that may process data in the United States and other countries. By using the Service, you understand that your information may be transferred to jurisdictions with different data-protection laws. We take steps designed to protect personal information in line with this Policy and applicable law.
14. Children
The Service is for users 18+. We do not knowingly collect personal information from children under 13. If you believe a child provided personal information, contact contact@123upvideo.com and we will take appropriate steps to delete it.
15. Changes
We may update this Policy periodically. We will post the revised version with a new "Last updated" date. Material changes may be highlighted in-product or by email when appropriate.
